Terms of Service

1. Service Description

AutoClub HQ ("the Service") is a web-based compliance tracking platform designed for auto club towing operations. The Service provides tools for tracking service declines, monitoring driver attendance, managing customer satisfaction surveys, and generating compliance reports. AutoClub HQ is operated by AutoClub HQ ("we", "us", "our").

2. Account Terms

By creating an account, you agree to the following:

• You must be at least 18 years of age to use the Service.
• You must provide accurate and complete information when creating your account and organization.
• The organization administrator is responsible for all activity under their account, including actions taken by invited team members.
• You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access.
• One person or organization may not maintain more than one free trial account.

3. Subscription & Billing

• AutoClub HQ offers a 14-day free trial with full access to all features. No credit card is required to start a trial.
• After the trial period, a paid subscription is required to continue using the Service.
• Subscriptions are billed on a monthly or annual basis, depending on the plan selected.
• All fees are stated in Canadian dollars (CAD) unless otherwise indicated.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.
• We reserve the right to change pricing with 30 days' written notice. Existing subscriptions will be honored at their current rate until the next renewal date.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to the Service, other accounts, or related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Upload or transmit viruses, malware, or any other malicious code.
• Use the Service to store or transmit content that is defamatory, fraudulent, or infringes on third-party rights.
• Resell, sublicense, or redistribute the Service without our prior written consent.

5. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using AutoClub HQ, you consent to the data practices described in the Privacy Policy.

6. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is the property of AutoClub HQ and is protected by intellectual property laws. You may not copy, modify, reverse-engineer, or create derivative works from any part of the Service.

You retain all rights to the data you upload to the Service. By using AutoClub HQ, you grant us a limited license to process and store your data solely for the purpose of providing the Service to you.

7. Limitation of Liability

To the maximum extent permitted by law, AutoClub HQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, upon reasonable notice. Reasons for termination may include, but are not limited to, violation of these Terms, non-payment, or extended inactivity.

Upon termination, your right to use the Service ceases immediately. We will make your data available for export for a period of 30 days following termination, after which it may be permanently deleted.

9. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We will notify account administrators of material changes via email.
